The Bhartiya Nyaya Sanhita Bill, 2023, which is set to replace the Indian Penal Code, has reintroduced adultery as a crime under clause 84. Under the new bill, even “enticing” women for illicit intercourse is now an offense. Previously, in 2018, the Supreme Court of India struck down adultery as an offense on grounds that it was discriminatory.
Let wait for while as adultery can not be done without the consent of the female partner, however consent is immaterial as it was considered offence against the Husband which was consider as the chattel property of the husband as per Indian Penal Code 1860.
